Legal Context
The Right of Access to Information Law is a legal framework that guarantees the public’s right to access government-held information. The Right to Access to Information (ATI) in Lebanon stands as a cornerstone of transparent governance, fostering accountability by exposing the evidence behind decision-making, and catalyzing efforts towards institutional reform. This fundamental right empowers civil society organizations, investigative journalists, oversight bodies, and citizen alike, enabling active participation in governance. In Lebanon, the Right to Access Information is governed by Law No. 28/2017, the implementation decree No. 6940/2020, and the subsequent amendment, and the amendment by Law No. 233/2021 is facilitated by two legal mechanisms: - Proactive Disclosure by governmental bodies and contracted entities - Specific Information Requests by citizens or organizations
Our Focus
ATI tracker is to promoting transparency and accountability within public institutions, directing its focus towards two specific modalities:
- Proactive Disclosure Monitor: Observe and evaluate governmental and public agencies' adherence to Proactive Disclosure requirements outlined in the Right to Access Information Law. This ensures ongoing oversight and maintenance of transparency standards.
- Information Requests Monitor: Spotlight key cases of Information Requests due to non-compliance with Proactive Disclosure obligations. Track and support the progress of these requests, assisting initiating parties to ensure case advancement through follow-ups and tools such as EKHBAR. This is crucial for reinforcing accountability and driving reform initiatives.
